We will assist a client either in the most basic of estate planning, which would include a simple Will or Revocable Trust, a Durable Power of Attorney, Living Will, and Health Care Proxy. We will also help formulate and implement more complex plans to avoid different types of taxes.
Where clients own family businesses, we provide specialized estate and tax planning assistance in creating, capitalizing, managing, financing, and continuing or selling the business. Often times, effective estate and business succession planning utilizes Limited Liability Companies and/or Family Limited Partnerships as a component of an integrated gift planning solution.
Medicaid Planning
Often we provide elder law counseling for our senior clients who want to secure their assets in the event that they go into a nursing home. In many instances and particularly for the more elderly client, we are aware that Medicaid planning should be a primary consideration in the client’s overall estate plan.
Medicaid planning will also arise when the client comes to us in the context of guardianship proceedings, and we will formulate and implement and overall plan to achieve the client’s goals.
